We beat Huntington National Bank (defended by Baker & Hostetler LLP) in Majestic v. Huntington before the federal Sixth Circuit appeals court. The case created national precedent. There, the court of appeals found that our business client could sue Huntington for refusing to refund our client's account for fraudulent checks written against it by others. That case revolved around a technical provision of the Uniform Commercial Code (UCC) Article 4 that requires banks to ensure the checks it cashes are "properly payable." That case is a class action and is still ongoing in the Southern District of Ohio federal court.
In Slorp v. LSR, we beat Bank of America (defended by McGlinchey Stafford PLLC) in another federal appellate decision. In that landmark case, the federal Sixth Circuit sided with our client in our first appeal, establishing we could sue the bank and its lawyers for violating the Racketeer Influence and Corrupt Organization Act (RICO) for robo-signing mortgage loans.
In a third federal appellate case, we beat Chase Home Finance (defended by Bricker & Eckler LLP) in Chase v. Marais. There, we established that consumers had the right to question the misapplication of payments by their mortgage company under the Real Estate Settlement Procedures Act (RESPA). After we won this appeal in Cincinnati, Ohio, Chase gave up and admitted wrongdoing. It publicly paid our client significant damages and our attorneys' fees.
