Lawyers Who Stop Junk Faxes, Texts, and Robo-Calls to Cell Phones

Did you know that it is illegal for a company to text you a message without your consent, or to call your cell phone with a pre-recorded message, or by using an automated dialer? It is also illegal to send a fax advertisement to anyone a business has never done business with. Federal law effectively outlaws nearly all business robo-calls to your cellular phone number unless you give the caller explicit permission to call you, and it prohibits all junk faxes. The damages available to a recipient of these kinds of communications are up to $1,500 per call or fax.

The federal law that governs these kinds of activities is called the Telephone Consumer Protection Act (TCPA), and it prohibits companies from advertising their goods/services using your cellular phone minutes or your fax machine’s paper and toner. You have the right not to pay for a company’s advertisements using your equipment or from robo-calling your cellular telephone!

If you have received these kinds of text messages, robo-calls, or faxes from companies without your permission, please contact Doucet & Associates about how we might be able to help stop these nuisances. Because so many fly-by-night companies illegally advertise this way, we are most likely going to be able to provide assistance against those companies that have physical locations in the United States, or appear to regularly conduct business in the United States using credit card transactions.

Attorney Troy Doucet has sued dozens of companies for violating the TCPA and Doucet & Associates is currently (2013-14) co-counsel in a major class action lawsuit against a mortgage company for placing collection calls to its customer’s cell phones.
